EXP Elite End Users License Agreement
EXP Elite END USER LICENSE AGREEMENT
IMPORTANT-READ CAREFULLY: Extractor Pro.Com, Inc. & Cyber Samurai Marketing, Inc. End-User License Agreement ("EULA") is a legal agreement between you (individual or single entity) and Extractor Pro.Com, Inc. for the Extractor Pro.Com, Inc. software accompanying this EULA, which includes computer software and associated media and printed materials, and may include "online" or electronic documentation ("Software Product" or "Software"). By opening the sealed packet(s) OR by exercising your rights to make and use copies of the Software Product, you agree to the terms of this EULA. If you do not agree to the terms of this EULA, promptly return this fax unsigned, and your rights for use will be revoked.
SOFTWARE PRODUCT LICENSE: The Software Product is protected by copyright laws and international copyright treaties as well as other intellectual property laws and treaties. The Software Product is licensed, not sold.
GRANT OF LICENSE- Extractor Pro.Com, Inc. grants you a nonexclusive, royalty-free right to make and use ONE COPY of the Software Product.
COPYRIGHT- All
title and copyrights in and to the Software Product (including but
not limited to any image, photographs, animations, video, audio,
music, text and "applets", incorporated into the Software
Product, are owned by Cyber Samurai Marketing, Inc. or its suppliers.
The Software Product is protected by copyright laws and international
treaty provisions. Therefore, you must treat the Software Product
like any other copyrighted material except that you may either (a)
make one copy of the Software Product solely for backup or archival
purposes, or (b) install the Software Product on a single computer
provided you keep the original solely for backup or archival purposes.
OTHER RESTRICTIONS: This EULA is your proof of license to exercise
the rights granted herein and must be retained by you. You may not
reverse engineer, de compile, or disassemble the Software Product,
except and only to the extent that such activity is expressly permitted
by applicable law notwithstanding this limitation.
LIMITED WARRANTY: NO WARRANTIES. Extractor Pro.Com, Inc. & Cyber Samurai Marketing, Inc., expressly disclaims any warranty for the Software Product. The Software Product and any related documentation is provided "as is" without warranty of any kind, either expressed or implied, including, without limitation, the implied warranties or merchantability, fitness for a particular purpose, or non infringement The entire risk arising out of use or performance of the Software Product remains with you.

that you have a seven (7) day money-back guarantee with this software.
All inquiries to arrange for a refund must be directed to Extractor
Pro.Com, Inc. Sales Department within seven days of your purchase
date at new sales@extractorpro.com with your request for a refund.
NO LIABILITY FOR CONSEQUENTIAL DAMAGES. In no event shall Extractor
Pro.Com, Inc. & Cyber Samurai Marketing, Inc. or their suppliers
be liable for any damages whatsoever (including, without limitation,
damages for loss of business profits, business interruption, loss
if business information, or any other pecuniary loss) arising out
of the use of or inability to use this product, even if the manufacture.
has been advised of the possibility of such damages. Because some
states/jurisdictions do not allow the exclusion or limitation of
liability for consequential or incidental damages, the above limitation
may not apply to you.
US GOVERNMENT RESTRICTED RIGHTS: The Software Product is provided with RESTRICTED RIGHTS. Use, duplication, or disclosure by the Government is subject to restrictions as set forth in subparagraph (c)(1)(ii) of The Rights in Technical Data and Computer Software clause at DFARS 252.227-7013 or subparagraphs (c)(1) and (2) OF THE Commercial Computer Software-Restricted Rights at 48 CFR 52.227-19, as applicable. MISCELLANEOUS: If you acquired this product in the United States, this EULA is governed by the laws of the State of Michigan. If this product was acquired outside the United States, local laws may apply.
PROXY SERVER: You cannot use the software with proxy server, AOL, CompuServe or a server behind a firewall. EXP Elite must have a direct connection to the Internet. Contact your ISP for their policy regarding mass mailings, they may require that you purchase an upgraded account with more allowable messages to be sent.
ANTI-SPAM POLICY: Extractor Pro.Com, Inc. has a strict NO-SPAM policy. This means that Extractor Pro.Com, Inc. will not assist you in finding/collecting/harvesting email addresses. Extractor Pro.Com, Inc. will not assist you in sending unsolicited mailings. If we find you are attempting to send unsolicited mailings using our software, we reserve the right to deny you any future support or service including upgrades, reissued codes, technical support or customer support. Sending unsolicited mailings with EXP Elite is considered a misuse of the product.
